Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Jeni mobile application (the "App") operated by Jeni ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using the App, you agree to comply with and be bound by these Terms. These Terms apply to all users of the App, including visitors and registered users. If you disagree with any part of these Terms, you may not access or use the App.

2. Age Requirement

The App is intended for users who are 18 years of age or older. By using the App, you represent and warrant that you are at least 18 years old. If you are under 18, you may not use the App.

3. Description of Service

Jeni is an AI-powered mobile application that allows users to interact with virtual AI characters through chat conversations. The App provides access to various characters across different scenarios and themes, enabling users to engage in conversations and build relationships with AI companions.

4. User Accounts and Registration

• You may create an account or use the App with a quick login feature.
• You are responsible for maintaining the confidentiality of your account information.
• You agree to provide accurate and complete information when creating your account.
• You are responsible for all activities that occur under your account.
• You must immediately notify us of any unauthorized use of your account.

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates any applicable law or regulation
• Engage in any abusive, harassing, threatening, or harmful behavior
• Attempt to gain unauthorized access to the App or its related systems
• Interfere with or disrupt the App or servers connected to the App
• Use automated systems or bots to interact with the App
• Reverse engineer, decompile, or disassemble any part of the App
• Copy, modify, or create derivative works of the App
• Use the App to transmit any malicious code, viruses, or harmful data
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Collect or harvest any information about other users

6. Content and AI Interactions

• The App provides AI-powered chat functionality with virtual characters.
• AI-generated responses are created by third-party AI services and may not always be accurate or appropriate.
• We do not guarantee the accuracy, completeness, or suitability of AI-generated content.
• You understand that interactions with AI characters are for entertainment purposes.
• You are responsible for the content of your messages and interactions within the App.

7. Intellectual Property

The App and its original content, features, and functionality are owned by Jeni and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

• You may not reproduce, distribute, modify, or create derivative works of the App without our express written permission.
• All trademarks, service marks, and trade names are the property of their respective owners.
• User-generated content remains your property, but you grant us a license to use it within the App.

8. Prohibited Content

You agree not to use the App to transmit, upload, or share content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Violates any person's privacy or rights
• Contains hate speech or discriminatory content
• Is sexually explicit or pornographic
• Infringes on intellectual property rights
• Contains spam or unsolicited promotional content
• Is fraudulent or deceptive

9. Service Availability

We strive to provide continuous and reliable service, but we do not guarantee that the App will be available at all times. The App may be unavailable due to maintenance, updates, technical issues, or other reasons beyond our control.

We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time with or without notice.

10. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Request by law enforcement or government agencies
• Discontinuance or material modification of the App
• Unexpected technical or security issues

You may terminate your account at any time by deleting the App or contacting us. Upon termination, your right to use the App will immediately cease.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not warrant the accuracy, completeness, or usefulness of any information provided through the App.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL JENI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

13. Indemnification

You agree to indemnify, defend, and hold harmless Jeni and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the App or violation of these Terms.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the App after any revisions become effective, you agree to be bound by the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction where Jeni operates, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall be resolved through good faith negotiations. If a dispute cannot be resolved through negotiation, it shall be subject to the exclusive jurisdiction of the courts in the appropriate jurisdiction.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms constitute the entire agreement between you and Jeni regarding the use of the App and supersede all prior agreements and understandings.
